Terms and conditions

During the waitlist phase only, a reservation saves your payment method without a charge. You can cancel before activation. Subscription billing begins when your reservation is activated for launch under the agreed billing terms. After the waitlist phase, new subscriptions follow the normal paid-order and billing provisions below.

These terms govern the Fragrance Monday membership between Fragrance Monday FM UG (haftungsbeschränkt) ("FM", "we") and consumers ("members"): a monthly edition of four 5ml fragrance vials, curated editorially around a single theme. Prices, any minimum term and shipping costs are shown on the membership page and in the order overview before you order. Membership prices are €39 per month (Monthly), €107 every three months (Quarterly) and €390 per year (Annual), including VAT. Each plan receives one edition each month.

FM curates, fills and ships fragrance samples of fragrances produced by third parties ("Partner Brands"), and facilitates full-bottle purchases from Partner Brands either through delivery directly by the Partner Brand or through referral links to its own store. FM is not the manufacturer or formulator of the fragrances it features, and is not the Responsible Person under Regulation (EC) No 1223/2009 (Cosmetics Regulation) for Partner Brand products as supplied in their original formulation, but assumes responsibility for the 5ml format as agreed in writing with each Partner Brand. Responsibility for the composition, safety, labeling and compliance of each fragrance in its original form lies with the relevant Partner Brand, whose name and contact details accompany each edition or are available on request at hello@fragrancemonday.com. Your statutory warranty rights against FM are not affected.

Your contract partner for a full-bottle order is shown on the product page before you order. Where you place a full-bottle order delivered directly by a Partner Brand, FM will share the personal data necessary to complete that order (name, shipping address, order details) with that Partner Brand, as described in our Privacy Policy. If you follow a referral link and buy from a Partner Brand's own store, that brand is the seller and handles your order and data. FM may receive a commission from Partner Brands on full-bottle sales.

We recommend testing any fragrance on a small area of skin before full use. Discontinue use immediately if irritation or an allergic reaction occurs. Members with known fragrance allergies or sensitive skin should check the enclosed ingredient list (INCI) before use.

Complaints relating to the composition, safety or labeling of a specific fragrance are forwarded, with your consent, to the relevant Partner Brand's Responsible Person. FM assists members through this process but does not itself carry product liability for the material composition of Partner Brand products.

The plans shown on our website are not a binding offer. By clicking "Subscribe with obligation to pay" you submit a binding order; before that step you can review and correct all entries in the order overview. The contract is concluded when we confirm your order by email. The contract language is English; we send you these terms and your order details with the confirmation.

The edition is charged when the contract is concluded, and each further charge falls on the same calendar day of the following month, quarter or year. The Monthly plan has no minimum term and can be cancelled at any time with effect from the end of the current billing month. Quarterly and Annual plans have a minimum term of three or twelve months respectively and can be cancelled with one month's notice before the end of the minimum term; otherwise they renew automatically for an indefinite period and can then be cancelled at any time with one month's notice. We will remind you by email before each Quarterly or Annual renewal. You can cancel in text form (e.g. by email to hello@fragrancemonday.com) or via the cancellation button on our website. Your statutory right of withdrawal applies in addition and is set out separately below.

Payments are processed by Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland, using the payment method you select (card or SEPA Direct Debit). If a charge fails, we will send you a reminder and pause shipping until the outstanding amount is settled.

We currently deliver to European Union member states only. Estimated delivery times will be communicated at the time of dispatch and are determined by the carrier. The statutory warranty rights for defects apply (§§ 434 et seq. BGB).

If a confirmed Partner Brand is unable to deliver at short notice for reasons outside our control, FM may substitute an equivalent fragrance of at least the same quality and value from another curated brand. We will notify you with the edition. Your statutory rights remain unaffected.

FM is liable without limitation for intent and gross negligence, and under the Product Liability Act. For ordinary negligence, FM is liable only for breach of a material contractual duty, and only up to the amount of foreseeable, contract-typical damage. Liability for injury to life, body or health is not limited. Primary liability for the material composition, safety and labeling of Partner Brand fragrances in their original form rests with the relevant Responsible Person; this does not affect any mandatory statutory liability FM may have as seller, distributor or filler.

Membership and product purchases require you to be at least 18 years old.

Publicly shared member content (e.g. reviews, photos, social posts referencing FM) may be reposted by FM for marketing purposes with attribution, unless the member objects by writing to hello@fragrancemonday.com.

FM may terminate a membership with reasonable notice where there is documented evidence of abuse, fraudulent payment activity (e.g. repeated chargebacks without basis), or material breach of these terms.

FM may amend these terms with future effect. Existing members will be notified by email at least 30 days before material changes take effect and may object or cancel their membership before the changes apply.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Consumers resident in another EU member state retain the benefit of any mandatory protective provisions of their country of habitual residence where these are more favorable. For merchants, legal entities under public law, or public special funds, Berlin is the exclusive place of jurisdiction.

Should any provision of these terms be or become invalid or unenforceable, the validity of the remaining provisions is unaffected. The invalid provision shall be replaced by a legally valid provision that comes closest to the economic purpose of the original.
